This document is a contractual agreement made between Perscilla Curley (referred to hereafter as “Photographer”) and The Client.


1 hour couple

Civil ceremony coverage at San Diego County Recorders Office (10144 Mission Gorge Rd, Santee, CA 92071) on Monday June 8th at 8:30am and one hour for the couples portraits to take place at Sunset Cliffs and Chicano Park to be taken Sunday June 7th at sunset. The Client will receive, via online gallery, a minimum of 60 edited digital images, and a print release. Please keep in mind that if more photos are delivered those are completely covered within this package and will be at no extra charge. Hi-resolution digital files are delivered via an online site. Files may be download via computer or phone only through the site. Clients shall receive sneak peek photos of their portrait session and wedding day by Tuesday, June 9th, typically up to 5 photos. Their entire portrait and wedding day gallery shall be delivered by Sunday, June 21st.

RETAINER AND PAYMENT: The Client shall remit a non-refundable retainer in the amount of $150 to the Photographer for performance of the services specified herein. Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation of wedding day package agreement by Client, the amounts paid are non-refundable. The remaining $200 for the wedding day package will be due morning of Monday June 8th by 8am. The remaining $200 can be paid via Venmo as the deposit was paid.

Portrait Session:

Portrait Session is to begin at 5:45pm on Sunday June 7th at Chicano Park (meeting destination to be determined). Please be sure to arrive on time and allow for time to find parking as shoot will begin at 5:45. We will shoot at this location for 30 minutes. If client arrives late that time will be deducted from their shoot time. After 30 minutes of shooting we will move to the second location, Sunset Cliffs (meeting point where sunset cliffs and ladera street intersect--If you follow sunset cliffs blvd to the end--I can send you pinned location) Shooting time to begin once we drive over, park and meet up. This should be by 7pm. Once we meet up we will then have 30 minutes of shoot time at Sunset Cliffs.

The Wedding Day:

Photographer will arrive to Santee Recorders Office by 8am to await the arrival of the Bride and Groom. Photographer will capture anticipation photos of heading into the courthouse. Ceremony is to begin at 8:30. Due to COVID-19 the photographer will wait outside during the ceremony and be there to capture the moment the bride and groom come out of the courthouse as married! Photographer will stay to capture photos after the ceremony and take photos of the couple and their guest.

GUARANTEE OF PHOTOGRAPHIC CAPTURES: The Photographer shall make every attempt to capture all photographs requested by the Client within the scheduled shoots, however, there is no guarantee that any particular photograph or pose can be acquired. Client acknowledges and warrants that the photographer shall not be liable for failure to capture any specific photographic image or pose. Client acknowledges and agrees that the number of images delivered shall vary depending upon circumstances including but not limited to, weather and lighting conditions. Unedited images will not be given to the client or third party under any circumstance.

COPYRIGHT: The Post Wedding Photographer retains all rights, including all copyrights in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website, social media accounts, and/or in Photographer’s studio. It is understood that any alteration of original images is strictly prohibited without the written permission of the Photographer. Alterations include, but are not limited to, application of filters, changing color images to black and white, cropping, or modifications of any kind. 

FAILURE TO PERFORM: If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, Photographer shall return the retainer to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited to a refund of all payments received from Client. 

ARBITRATION: Any controversy or claim arising out of or relating to this contract, or a breach thereof, shall be settled by arbitration, administered in accordance with the Commercial Arbitration Rules of the American Arbitration Association, administered by a licensed Arbitrator in the jurisdiction closest to the Photographer’s office and the arbitration award may be entered for judgment in any court having jurisdiction thereof. Notwithstanding the foregoing, either party may refuse to arbitrate when the dispute is for a sum less than $100. In no event shall an award in an arbitration initiated under this clause exceed the contracted price of the controversy in dispute.

INDEMNIFICATION: Photographer shall be held harmless for any and all injury to Client during the course of the photographic event and the immediately surrounding events.

MISCELLANY: This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement.
